Gardeners Tooting Service Terms and Conditions
These Terms and Conditions set out the basis on which Gardeners Tooting provides gardening and related services to residential and commercial customers. By making a booking, accepting a quotation, or allowing our gardeners to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any services.
1. Definitions
In these Terms and Conditions, the following words have the meanings given below:
Client means any individual, company, or organisation that requests or receives services from Gardeners Tooting.
Services means any gardening, garden maintenance, lawn care, hedge trimming, planting, clearance, soft landscaping, or related works provided by Gardeners Tooting.
Agreement means the contract formed between Gardeners Tooting and the Client, incorporating these Terms and Conditions and any written quotation or confirmation of booking.
Site means the garden, grounds, or property where the Services are to be carried out.
2. Booking Process and Quotations
2.1 Bookings may be made by the Client by contacting Gardeners Tooting and providing details of the required Services, the Site address, and preferred dates. All bookings are subject to availability and to acceptance by Gardeners Tooting.
2.2 Gardeners Tooting may provide a quotation based on information supplied by the Client, which may include descriptions, photographs, or measurements. The Client is responsible for ensuring that any information provided is accurate and complete.
2.3 In some cases, Gardeners Tooting may need to conduct a site visit before confirming a quotation. Any quotation following a site visit will be based on the conditions observed at the time of the visit.
2.4 Quotations may be provided either as a fixed price for the job or as an estimate based on an hourly or daily rate. Where an estimate is given, the final charge will reflect the actual time spent and materials used.
2.5 A booking is deemed confirmed when Gardeners Tooting issues a booking confirmation, which may include the agreed scope of work, price structure, and provisional date or schedule for the Services.
2.6 Gardeners Tooting reserves the right to amend or withdraw a quotation if the information provided by the Client is inaccurate, or if there are changes to the Site or the scope of the work before the Services commence.
3. Client Obligations and Access
3.1 The Client must ensure that Gardeners Tooting has safe and reasonable access to the Site on the agreed date and time. This includes arranging access through gates, communal areas, or buildings as necessary.
3.2 The Client must inform Gardeners Tooting in advance of any hazards, restrictions, or special requirements at the Site, including but not limited to uneven ground, fragile surfaces, underground cables or pipes, ponds, or protected trees.
3.3 The Client is responsible for securing pets and informing Gardeners Tooting of any specific concerns related to neighbours, shared spaces, or access routes.
3.4 The Client should ensure that the Site is reasonably clear of obstacles, large items, or personal belongings that may prevent or delay the performance of the Services. Additional time spent clearing such items may be charged separately.
4. Scope of Services
4.1 Gardeners Tooting will provide the Services with reasonable skill and care, in accordance with the description set out in the agreed quotation or booking confirmation.
4.2 Any changes to the scope of the Services requested by the Client must be agreed in advance. Gardeners Tooting may revise the price or timings to reflect any agreed variation.
4.3 Gardeners Tooting does not undertake structural works, major tree surgery, or any services requiring specialist licences or qualifications unless expressly agreed in writing.
4.4 Planting and horticultural work is subject to natural conditions. While Gardeners Tooting will use reasonable care in carrying out such work, it cannot guarantee the long-term survival of plants, lawns, or trees once handed over to the Client.
5. Payments and Charges
5.1 Charges for the Services will be as set out in the quotation or booking confirmation. Unless otherwise stated, prices are quoted in pounds sterling and are exclusive of any applicable taxes.
5.2 Gardeners Tooting may require a deposit or advance payment for certain works, particularly for larger projects or where materials must be purchased in advance. Any deposit requirements will be notified to the Client prior to confirmation of the booking.
5.3 The balance of payment is usually due on completion of the Services, unless otherwise agreed. For ongoing maintenance contracts, payment terms may be weekly, fortnightly, or monthly as specified in the Agreement.
5.4 Payment methods will be communicated to the Client during the booking process. The Client must ensure that payment is made in full and on time. Late payments may incur interest at the statutory rate, together with reasonable administration costs incurred in recovering overdue amounts.
5.5 Gardeners Tooting reserves the right to suspend or cancel further Services if any outstanding amounts remain unpaid.
6. Cancellations and Rescheduling
6.1 If the Client wishes to cancel or reschedule a booking, they must provide as much notice as reasonably possible to Gardeners Tooting.
6.2 For one-off visits or projects, Gardeners Tooting may charge a cancellation fee if the Client cancels with short notice, typically within 24 hours of the scheduled start time. The specific cancellation terms will be set out in the quotation or booking confirmation where applicable.
6.3 For regular maintenance visits, occasional rescheduling may be accommodated where practicable, but Gardeners Tooting cannot guarantee an alternative slot within the same period. Repeated cancellations may lead to adjustment of the maintenance schedule or termination of the arrangement.
6.4 Gardeners Tooting reserves the right to cancel or postpone a booking due to adverse weather, staff illness, access issues, or other circumstances beyond its reasonable control. In such cases, Gardeners Tooting will seek to reschedule the work at the earliest convenient time for both parties.
6.5 If Gardeners Tooting arrives at the Site at the agreed time and is unable to gain access, or if the Site is not in a condition that reasonably allows the Services to be carried out, this may be treated as a late cancellation by the Client and a call-out or cancellation fee may apply.
7. Materials, Equipment and Waste
7.1 Unless otherwise agreed, Gardeners Tooting will provide its own tools and equipment required to perform the Services. The Client must not use or operate Gardeners Tooting equipment without express permission.
7.2 Where materials, plants, turf, or other items are supplied by Gardeners Tooting, the cost will be included in the quotation or charged separately as agreed. Ownership of such materials passes to the Client upon full payment.
7.3 Garden waste generated during the Services will be dealt with in line with applicable waste regulations. Options may include: leaving waste neatly bagged or piled on site for the Client to dispose of; using the Client's own garden waste bins where available and permitted; or arranging removal of waste by Gardeners Tooting for an additional charge.
7.4 Any agreement to remove green waste or other waste from the Site will be clearly explained to the Client, together with any associated charges. Gardeners Tooting will comply with relevant waste carriage and disposal rules when transporting and disposing of such waste.
7.5 Gardeners Tooting is not responsible for disposing of hazardous waste, soil contamination, or items that fall outside normal garden waste, such as electrical items, rubble, or household rubbish, unless specifically agreed in writing.
8. Client Property and Site Conditions
8.1 Gardeners Tooting will take reasonable care to avoid damage to the Client's property. However, the Client acknowledges that gardening work may involve the use of machinery and tools, and that minor disturbance to soil, turf, or existing planting may be unavoidable.
8.2 The Client should identify and, where possible, clearly mark any hidden features such as irrigation systems, cables, or pipes. Gardeners Tooting cannot accept liability for damage to underground or hidden services that have not been properly identified and communicated in advance.
8.3 The Client is advised to move or protect valuable or fragile items in areas where work will be carried out. Gardeners Tooting will not be responsible for damage to items that could reasonably have been removed or safeguarded by the Client prior to the work.
9. Liability and Insurance
9.1 Gardeners Tooting will carry appropriate insurance cover for its activities, including public liability insurance, in line with usual industry practice.
9.2 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
9.3 Subject to the above, Gardeners Tooting shall not be liable for: loss of profits, business, revenue, or anticipated savings; indirect or consequential loss; or any losses arising from factors beyond its reasonable control, including extreme weather, pests, plant diseases, or acts of third parties.
9.4 Where Gardeners Tooting is found liable for direct loss or damage to the Client's property, such liability will be limited to the cost of repair or replacement of the damaged property or to the total price paid by the Client for the relevant Services, whichever is lower, unless otherwise required by law.
10. Complaints and Quality
10.1 Gardeners Tooting aims to provide a reliable and professional service. If the Client is dissatisfied with any aspect of the Services, they should raise the issue as soon as possible so that Gardeners Tooting has an opportunity to investigate and, where appropriate, rectify the matter.
10.2 Any complaints about the quality or conduct of the Services should be reported within a reasonable time after completion of the visit or project. Gardeners Tooting may request photographs or a further site visit to assess the complaint.
10.3 Where a complaint is upheld, Gardeners Tooting may, at its discretion, re-perform part of the Services, offer a partial refund, or agree another form of resolution, taking into account the nature of the work and the circumstances.
11. Cancellations by Gardeners Tooting
11.1 Gardeners Tooting may cancel the Agreement with immediate effect by giving written or verbal notice to the Client if the Client materially breaches these Terms and Conditions, fails to make payment when due, or behaves abusively or unreasonably towards staff.
11.2 In the event of cancellation by Gardeners Tooting other than for the reasons set out above, any advance payments for Services not yet provided will be refunded to the Client.
12. Data Protection and Privacy
12.1 Gardeners Tooting will collect and use personal information from Clients for the purposes of providing the Services, managing bookings, processing payments, and communicating about ongoing or future work.
12.2 Client information will be handled in accordance with applicable UK data protection laws. Gardeners Tooting will take reasonable steps to keep such information secure and will not share it with third parties except where necessary to perform the Services, comply with legal obligations, or with the Client's consent.
13. Amendments to Terms and Conditions
13.1 Gardeners Tooting may update or amend these Terms and Conditions from time to time. The version in force at the time of the booking will apply to that particular Agreement.
13.2 Updated Terms and Conditions may be made available on request or on the company website where applicable. Continued use of the Services following any update will be taken as acceptance of the revised terms for future bookings.
14. Governing Law and Jurisdiction
14.1 These Terms and Conditions and any Agreement between Gardeners Tooting and the Client shall be governed by and construed in accordance with the laws of England and Wales.
14.2 Any dispute arising out of or in connection with these Terms and Conditions or the provision of the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
By proceeding with a booking or allowing Gardeners Tooting to commence work at the Site, the Client confirms that they have read, understood, and agree to these Terms and Conditions.
